Who completes an LPE1 form?

The LPE1 is directed at whoever holds the management information for a building. Who that is depends on how the building is run — and in a self-managed block, it usually falls to a volunteer director.

Where a managing agent is appointed

If the building has a professional managing agent, the agent normally completes the LPE1 and charges a fee for doing so. They hold the accounts, insurance and works records, so they are best placed to answer.

Where the freeholder manages directly

If the freeholder manages the building without an agent, the freeholder answers the form using their own records.

Where the building is self-managed (RMC or RTM)

In a building run by a Resident Management Company or a Right to Manage company without an agent, the company completes the LPE1. In practice that means its directors — often volunteers with day jobs, doing it for the first or second time. There is no requirement to instruct a professional; the directors can complete it themselves from the building's records.

When more than one party is involved

Sometimes two packs are needed. If ground rent is collected by a freeholder while service charges are administered by an RMC, each may answer for their own part. The seller's conveyancer will usually work out who to approach from the lease and the seller's information.

What this means for self-managed buildings

For a self-managed block the real question is logistical, not legal: who has the insurance schedule, who knows the reserve fund balance, and who remembers what was agreed about the roof. Keeping a shared building record, rather than relying on one director's inbox, is the single biggest improvement most buildings can make.
